Terms & Conditions

These terms govern private charters booked with La Zingara Catamaran Charters. By confirming a reservation you agree to the conditions below on behalf of yourself and all guests.

1. Booking process

• All enquiries are provisional until we issue written confirmation. Availability can change quickly during peak months.
• A deposit stated in your quote must be paid to secure the date. The balance and any security deposit are due no later than seven (7) days before departure unless your contract specifies otherwise.
• Quotes are valid for 7 days. After this period pricing may change without notice.
• We reserve the right to decline bookings that exceed safe capacity or conflict with maritime regulations.

2. Client responsibilities

• Provide accurate guest numbers, dietary requirements and access needs at least five (5) days prior to sailing.
• Arrive at the agreed embarkation point 15 minutes before departure. Late arrivals may shorten your charter without refund.
• Follow the captain’s instructions at all times. The captain has ultimate authority over navigation, safety and behaviour on board.
• Guests must respect Maltese maritime law, including restrictions on smoking, littering, alcohol consumption and noise.
• Any damage or excessive cleaning caused by your group will be invoiced at cost with supporting evidence.

3. Cancellations and changes

• You may cancel in writing. Deposits are non-refundable, but we will try to reschedule subject to availability.
• For cancellations within 14 days of departure the full charter fee is payable. We recommend taking out travel insurance that covers private charters.
• Minor itinerary changes (e.g. swim stops) can be requested up to 48 hours before sailing and are subject to crew approval.

4. Weather and safety

• The captain may alter the itinerary, delay departure or cancel the charter if weather or sea conditions make sailing unsafe. We prioritise guest safety over schedule.
• If we cancel before departure due to weather you may choose a full refund of all amounts paid or move the booking to a mutually agreed date within 12 months.
• If weather deteriorates during a charter the captain may return to port earlier than planned. Pro-rata refunds are offered only when less than half of the charter has been delivered.

5. Catering and beverages

• Outside catering is welcome with prior notice. All vendors must follow crew safety instructions while on board.
• Guests must comply with Maltese alcohol regulations. We reserve the right to refuse service to anyone who appears intoxicated.
• Glassware is discouraged on deck. We can provide reusable alternatives on request.

6. Liability

• We carry comprehensive vessel insurance and public liability cover as required by Maltese law.
• Our liability for any claim arising from the charter is limited to the total fees paid, except where prohibited by law.
• We are not responsible for personal belongings lost or damaged during the charter unless caused by our negligence.
• Nothing in these terms limits liability for death or personal injury caused by our negligence or fraud.

7. Photography and marketing

We may take onboard photographs for promotional use. Please notify the crew before departure if you prefer not to be photographed.

8. Data protection

We process personal data to manage your booking in line with our Privacy Policy. You are responsible for sharing this notice with your guests.

9. Governing law

These terms are governed by the laws of Malta. Any dispute shall be submitted to the exclusive jurisdiction of the Maltese courts.
